1. Scope & Acceptance
These Terms of Service (“Terms”) govern your use of the website mp3tomp4.app (“Service”), operated by the provider identified in our Legal Notice. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. Service Description
mp3tomp4.app is a free, browser-based tool that converts audio files (MP3 and other formats) into MP4 video files by combining them with cover art. All file processing occurs entirely in your browser using WebAssembly technology. No files are uploaded to our servers at any point.
3. User Obligations
By using the Service, you represent and warrant that:
- You have the necessary rights, licenses, or permissions to use any audio files and images you process through the Service, or your use qualifies under applicable copyright exceptions.
- You will not use the Service for any purpose that violates applicable law, including but not limited to copyright infringement, distribution of illegal content, or fraud.
- You will not attempt to reverse-engineer, decompile, or disrupt the Service, its infrastructure, or its security mechanisms.
- You will not use automated means (bots, scrapers) to access the Service in a manner that impairs its availability for other users.
4. Intellectual Property
Your content: You retain all rights to the audio files, images, and videos you create using the Service. We claim no ownership or license over your content. Since all processing happens in your browser, we never have access to your files.
Our content: The Service itself — including its design, code, text, graphics, and branding — is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
5. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Conversion results depend on your browser capabilities, device resources, and input file quality. We cannot guarantee specific output quality or compatibility with every platform.
6. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service.
- Any unauthorized access to or alteration of your transmissions or data.
- Any content or conduct of any third party on the Service.
- Any other matter relating to the Service.
This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis. This does not affect liability for damages from injury to life, body, or health, or liability for intent and gross negligence (Vorsatz und grobe Fahrlässigkeit), which cannot be excluded under German law.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we handle data. In short: your files never leave your device, and we use analytics only with your explicit consent.
We employ the following third-party data processors to operate this Service: Vercel Inc. (hosting and infrastructure), Google Ireland Limited (analytics, loaded only with your consent), and jsDelivr / Prospect One (CDN for WebAssembly assets). 8. Service Availability & Changes
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may update these Terms from time to time. The updated version will be indicated by the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer within the EU, you also benefit from any mandatory provisions of the consumer protection law of your country of residence.
For disputes with consumers, the courts at the consumer's place of residence shall have jurisdiction. For all other disputes, the exclusive place of jurisdiction is the registered seat of the operator as stated in the Legal Notice.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the intent of the original.
